Terms, Conditions & Additional Information for Contracts Fulfilled by New Image Landscape and Pools LLC , herein thereafter referred to as NILP:

Terms: Clients agree to release and hold harmless NILP and its representatives from any and all liabilities, claims, costs of legal defense, and damages for any services fulfilled, provided, contracted, referred, or rendered by or through NILP. You (the client) expressly agree to assume any and all liabilities, claims, costs of legal defense, and damages on behalf of NILP and its representatives associated with any services fulfilled, provided, contracted, referred or rendered to you (the client) by or through NILP , except those of gross negligence by NILP employees, representatives, or contractors. The opinions, recommendations, evaluations, and documentation provided by NILP , its representatives, partners, and affiliates are for informational purposes only. Although the information and recommendations provided are presented in good faith and believed to be correct as of the date they were submitted, NILP , its representatives, partners, and affiliates makes no representations or warranties as to the completeness or accuracy of the information. I give my permission to NILP to photograph me and my representatives/clients and use my name/company name/logo for use in NILP marketing and I will not seek compensation for such use. Personnel Terms: Clients, associates, assigns and affiliates agree to not solicit, approach, recruit, or otherwise employee for any purpose any NILP employees for any security, investigative, training, or consulting services provided by NILP for a period of 2 years from the date of the last engagement of services without express written consent of James Stewart.
Fees and or Length of time Terms: A two hour minimum will be assessed for all jobs at the rate of $45.00/hour per man or more and a five hour minimum will be enforced for all jobs that exceed 100 miles round trip at $45.00/hour unless otherwise noted. ALL Service request will be accessed a trip charge of $95.00 regardless whether any services are rendered or not, in addition to the hourly rate. Travel time in excess of one hour round trip will have added charges associated with the service request. NILP may bill at time +1/2 for the following holidays: New Years Eve (full day) & New Years Day, Martin Luther King Jr. Day, President’s Day, Easter, Memorial Day, Independence Day, Labor Day, Veteran’s Day, Thanksgiving Eve (full day)&Day, Christmas Eve (full day) & Day. NILP bills overtime according to Arizona and Federal Labor Law when a specific guard exceeds regular pay by client request. I understand and agree that these terms and rates will apply to any service request that is submitted and isn’t covered under my current warranty.
Payment & Cancellation Terms: Services confirmed and cancelled five business days prior to the rendering of services may incur a 40% charge of the invoice and services cancelled within two business days prior to the scheduling of services rendered may incur a 60% charge of the invoice due within thirty (30) days of the cancellation. All electronic payments including PayPal, credit card, and debit card transactions incur an additional 5% fee. Payment may be received by cash, direct deposit, wire transfer, check, or electronic check without an additional fee. NILP reserves the right to adjust hourly cost and fees as needed per client request. Returned checks incur a $45.00 processing fee. Estimates/Invoices may be provided to clients prior to services being rendered. Adjusted and finalized invoices may be provided to clients after services are rendered. Clients may be asked to provide a retainer or deposit prior to work being performed. Terms of payment on the invoices must be adhered to or a 20% late charge will be assessed and billable per thirty (30) days the invoice remains unpaid.
Legal Action: If any civil action is necessary to enforce the terms of this agreement, the parties agree that any such legal action shall be resolved through binding arbitration. You agree to assume all fees associated with the collection of any civil action by NILP.
Future Contractual Obligations: By submitting this form, contracting and/or utilizing services you agree to the terms, conditions, and additional information is to be adhered to for this and all future services requested and/or rendered. After submission of this initial agreement, clients agree to it in its entirety and shall apply these terms, conditions, and additional information to include but not limited to any services provided or brokered by NILP and scheduled/confirmed by any means. NILP reserves the right to modify this agreement in writing.
